Conditions de vente et de licence
Comment fonctionnent l'achat, la licence et l'utilisation de Visaria.
The short version. Visaria is sold as a yearly licence for one computer on one operating system. Payments are handled by our payment provider, who acts as the reseller. The free 7-day trial needs no payment card and never turns into a paid plan on its own. Your licence renews each year until you cancel, and we remind you before it does. A gift licence is one year, paid once, and does not renew. Visaria is an educational tool whose results are indicative, not a validated engineering solver. Nothing here affects your legal rights as a consumer.
1. About us and these terms
Visaria is a product of FastStep Labs. FastStep Labs is the trading name of Richard Gordon, based in the UK. Our address is FastStep Labs, 124 City Road, London, EC1V 2NX. You can contact us at help@visaria.dev. In these terms, "we", "us" and "our" mean FastStep Labs, and "you" means the person using our website or software.
These terms cover your use of our website, the Visaria desktop application ("the Software"), the free trial and any paid licence. Please read them before you buy. If you are buying as a consumer, you have legal rights that these terms cannot remove; section 13 explains them.
2. How buying works: our payment provider
We sell through a third-party payment provider that acts as the merchant of record and authorised reseller for Visaria (our "payment provider"). When you buy, you pay our payment provider, and your payment, invoice, taxes and payment disputes are governed by Paddle.com Market Limited's buyer terms, which are shown to you at checkout. Your right to use the Software is a licence from us under these terms.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
We never see or store your full card details. See our Privacy Policy for how personal data is shared between us and our payment provider.
3. Plans and prices
We offer a free 7-day trial and two paid plans, Selected Solvers and Pro Bundle. Each paid plan is a yearly licence. The table below summarises what each option includes. Our pricing page and checkout always show the current prices, including any VAT or sales tax, before you pay.
| Feature | Free 7-day Trial | Selected Solvers | Pro Bundle |
|---|---|---|---|
| Solver access | Aero, Gas, Thermal, Water | You choose from Aero, Gas, Thermal, Water | Every current solver |
| Grid resolution | Flexible and nested refinement for Aero | Flexible and nested refinement for Aero | Flexible and nested refinement for Aero |
| Learning Hub | Sample access | Full access | Full access and early beta |
| Export and sharing | Watermarked images | No watermark | No watermark |
| Support | Community forum | In-app help and forum | In-app help and forum |
Selected Solvers is priced per solver. If you buy more than one solver, each is a separate yearly licence with its own licence key, renewal date and cancellation. Pro Bundle covers every solver we offer at the time you buy, in one licence. A solver launched after you buy is not part of the plan you bought; see section 11.
Each licence is for one operating system. Windows, macOS and Linux versions are sold as separate products. At launch only the Windows version is available; the macOS and Linux versions are coming soon. A licence bought for one operating system will not activate the Software on another. If you need Visaria on two operating systems, you need two licences. Please check you are buying the right version at checkout. If you buy the wrong one by mistake, email licensing@visaria.dev within 14 days and we will swap it.
Gift licences
You can buy a Pro Bundle licence as a gift for someone else. In this section, "you" means the person who buys the gift (the buyer) and "the recipient" means the person you are giving it to.
- What it is. One year of Pro Bundle for one computer on one operating system, as described in section 6. It is a one-off payment. It does not renew, so there is no later charge and nothing for the recipient to cancel.
- How it is delivered. At checkout you enter the recipient's email address and choose to send the licence key now, or on a date and time in a time zone you choose. We email the key and instructions to that address at the time you chose. You receive your own order confirmation. The licence is linked to the recipient's email address (section 6).
- When the year starts. The licence year starts when we deliver the key to the recipient, not when you pay. A gift scheduled for later therefore keeps its full year.
- A wrong or bounced email address. Please check the address carefully. If you entered it wrongly, or the email bounces, email help@visaria.dev with your order number. Before delivery we will correct the address. If we learn that a delivery bounced, we will tell you and allow one correction. If the key went to a real address that is not the one you meant and it has not been activated, we may cancel that key and send a new one once. We cannot replace or refund a key that someone else has already activated.
- What a gift licence is not. It cannot be exchanged for money or for another plan. Once delivered, it belongs to the recipient on the same terms as any other licence, including that it is personal and non-transferable (section 6).
- New solvers. Section 11 applies to gift licences: a new solver launched during the licence year is offered to the recipient at a significant discount to its normal price.
- When the year ends. As the year nears its end, the Software shows the recipient a message pointing them to the Visaria website. When it ends the solvers stop working, but the recipient's files stay on their computer (section 8). They can then buy a licence from our pricing page.
- Tax and where it can be sent. The buyer's country, and our payment provider, determine any VAT or sales tax. You can send a gift to any email address, but you can only buy in a country where our payment provider sells Visaria.
- Who can buy, and the recipient's details. If you are under 18, ask a parent or guardian to buy the gift (see section 12 of our Privacy Policy). Buy only for someone you know, and enter their email address only so that we can deliver this gift. The recipient must be at least 13 years old. Our Privacy Policy explains how we use the recipient's email address.
4. Free trial
You can try Visaria free for 7 days. You request the trial on our website by entering your email address, and we email your trial key to that address. No payment card is needed, and our payment provider is not involved in the trial.
- The trial is a limited version of the Software, as shown in the trial column of the table in section 3: sample access to the Learning Hub, watermarked exports, and community forum support.
- It ends automatically after 7 days. It does not turn into a paid plan and you will not be charged.
- One trial per person and per computer. We use your email address to prevent repeat trials, so a further request with the same address will not receive a new key. We may also decline further trials if we see repeated sign-ups.
- The trial is provided free and as it is. Your statutory rights still apply, but because you pay nothing, the price-based remedies in section 13 do not.
5. Student licences
We offer a discounted licence to people aged 16 and over in full-time education at a university, college, sixth form or equivalent level. Student licences are available on request by emailing licensing@visaria.dev from your institution email address.
- We may ask for reasonable evidence that you are eligible, such as an institution email address or a current student ID. We only use this to check eligibility (see our Privacy Policy).
- Student licences are for your own learning and coursework, not for paid or commercial work.
- At renewal we may ask you to confirm you are still eligible. If you are not, you can renew at the standard price.
- If you obtained a student licence by giving false information, we may end it after telling you why. You can switch to a standard licence by paying the difference for the remainder of the year.
- Student licences are open to people aged 16 and over in full-time education. If you are under 18, a parent or guardian must apply for and buy the student licence and accept these terms for you.
6. Your licence
When you buy Selected Solvers or Pro Bundle, we give you a personal, non-exclusive, non-transferable licence to install and use the Software on one computer, on the operating system you bought it for, for the licence year you have paid for and any renewals.
Your licence is linked to the email address used at purchase (for a gift licence, the recipient's email address) and to a computer ID generated from your computer (the "computer ID"). The computer ID is a salted one-way hash of your computer's characteristics, so it identifies the machine, not you. The Software activates online once with our licensing service and then works offline, with the licence rechecked every 30 days as described in section 15. We explain how the computer ID is handled in our Privacy Policy.
Standard licences may be used for commercial, personal learning and teaching only. Note, as stated in section 7, Visaria is not designed as an engineering grade solver and is indicative only. Contact us for academic and institutional licensing.
Moving to a new computer
You can move your licence to a different computer by deactivating it on the old one in the app under Settings → Licence, then activating it on the new one. If your old computer has failed, been lost or stolen, or you cannot deactivate it, email licensing@visaria.dev and we will reset your activation. To prevent misuse, we may limit resets to 3 per licence year, but we will always help with genuine hardware failures.
What you must not do
- Share, sell, lend or publish your licence key, or use one licence on more than one computer at a time.
- Bypass, disable or tamper with the licensing or activation system.
- Copy, modify, decompile or reverse engineer the Software, except where the law specifically allows you to do so (for example, making a back-up copy or achieving interoperability).
- Remove our copyright notices or use the Visaria name or logo to suggest we endorse you.
- Use the Software in breach of any law.
7. What Visaria is and is not
Visaria is an interactive learning instrument for fluid dynamics, structures and related physics. It is deliberately coarse and is designed to rapidly show behaviour and build understanding. Its results, including force coefficients such as Cd and Cl, are indicative and intended as a convergence monitor, not as validated engineering values.
Visaria is not a validated engineering solver. Do not rely on it for design, certification, safety-critical or other decisions where the accuracy of results matters. We describe its limitations in the Software and on our website, and the Software is supplied on that description.
8. Your files
Scenario files, images, videos and other material you create with the Software belong to you. They are stored on your computer; we do not receive them unless you send them to us, for example with a support request. If your licence ends, your files remain yours and stay on your computer.
9. Yearly renewal
Paid licences run for one year from the date of purchase and then renew automatically for another year at the then-current price, charged by our payment provider to your saved payment method, until you cancel.
- We will email you at least 30 days before each renewal, telling you the renewal date, the price, and how to cancel.
- If the price is going up, we will tell you in that reminder, and you can cancel before the renewal date without charge.
- If a renewal payment fails, our payment provider may retry it. If it cannot be collected, your licence will end at the end of the paid year.
This section does not apply to gift licences, which run for one year from delivery and never renew (see section 3).
10. How to cancel
You can cancel at any time, in a few clicks, from the customer portal link in your purchase or renewal emails, or by emailing us at help@visaria.dev with the email address you bought with. We will confirm cancellation by email.
Cancelling stops the next renewal. Your licence keeps working until the end of the year you have already paid for. After that, the solvers stop functioning until you renew, but your files remain accessible for viewing.
To make sure a cancellation is processed before the renewal charge, please cancel at least 48 hours before your renewal date. Renewal charges are not refundable except as set out in section 12.
11. Updates and support
While your licence is active, you get the updates and new versions we release for your plan and operating system. Updates may change features, but we will not remove the core features of the plan you bought during a paid year.
New solvers. A new solver launched during your licence year is not included in a plan you have already bought. We will offer it to existing customers, including Pro Bundle customers, at a significant discount to its normal price. This applies to gift licences too.
We support the operating system versions and hardware listed in the FAQs on our home page. Visaria needs a graphics card that supports WebGPU; please try the free trial to check compatibility before buying. We may stop supporting older operating systems in future versions, and we will tell you before a renewal if your system will no longer be supported.
Support is provided through in-app tool tips, work sheets and help information, and via our community forum, as shown in the table in section 3. To report bugs, please use the bug area of the forum. For licensing assistance, you can email licensing@visaria.dev, and we aim to reply within 3 working days.
12. Cancelling your purchase and refunds
Please use the free 7-day trial to check that Visaria runs on your computer and suits you before you buy.
Your 14-day right to cancel, and how it ends
Under the Consumer Contracts Regulations 2013, consumers normally have 14 days to cancel an online purchase. Because your licence is digital content supplied straight away, you will be asked at checkout to tick a box to:
- agree that we start supplying your licence immediately, within the 14-day cancellation period; and
- acknowledge that you will lose your right to cancel once your licence key has been delivered to you.
You cannot complete a purchase without ticking the box. We confirm your agreement in the email that delivers your licence key. Once the key has been delivered, you no longer have the right to cancel for a change of mind.
If for any reason you were not asked for, or did not give, that agreement, you keep your right to cancel within 14 days of purchase. Email us and we will arrange a full refund through Paddle.
Gift licences
- Before delivery. If you chose a later delivery date and want to cancel before the key is sent, email help@visaria.dev with your order number before the delivery time. Refunds are issued by Paddle under its buyer terms (see section 2), so the refund is subject to Paddle's Refund Policy.
- When your right to cancel ends. For a gift, the box at checkout asks you to agree that we start supplying the licence when we deliver the key to the recipient, and to acknowledge that you lose your right to cancel once it has been delivered.
- After delivery. "When we refund" below applies, and refunds are at our discretion. A refund is paid to the buyer's original payment method by Paddle, and the key is deactivated.
- If the Software is faulty. The recipient did not pay, but we give them the same help as a buyer under section 13. They can email help@visaria.dev with the order number, which the buyer can pass on to them.
When we refund
- Faulty software. If the Software is faulty or not as described, you have the rights explained in section 13, which may include a refund.
- Our discretion. Outside those cases, any other refund is at our discretion, for example if you bought the wrong operating system (see section 3).
Paddle's Refund Policy gives UK consumers on a yearly licence a further 14 days from each automatic renewal to ask for a refund of that renewal charge. Otherwise, renewal charges are not refundable except under section 13 or at our discretion. We remind you before each renewal (section 9) so you can cancel in time.
To ask for a refund, email help@visaria.dev with your order number. Refunds are issued by Paddle.com, as our Merchant of Record, under Paddle's buyer terms, and are paid to your original payment method. Your licence key is deactivated once an approved refund is processed.
13. If something is wrong with the Software
If you are a consumer, the Consumer Rights Act 2015 says digital content must be of satisfactory quality, fit for purpose and as described. If it is faulty, you are entitled to a repair or replacement. If we cannot fix it within a reasonable time and without significant inconvenience to you, you may be entitled to a partial or full refund. If faulty digital content we supplied damages your device or other digital content, and this happened because we did not use reasonable care and skill, we will either repair the damage or pay you compensation.
For more on your rights, contact Citizens Advice (England, Wales and Scotland) or Consumerline (Northern Ireland).
14. Our responsibility for loss or damage
If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. We supply the Software for domestic, private and educational use; we are not liable to consumers for any loss of profit, business or business opportunity.
If you are a business (including schools, universities and other organisations): we are not liable for loss of profits, revenue, business, data or goodwill, or for indirect or consequential loss. Our total liability to you in any licence year is limited to the price you paid for that year.
For everyone: nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited. Because Visaria's results are indicative (section 7), we are not responsible for decisions you make based on them where that goes beyond its described educational purpose.
15. When we may end your licence
We may suspend or end your licence if you seriously or repeatedly break section 6 (for example, by sharing your key or tampering with licensing). Except where the breach is deliberate or we need to act urgently to prevent misuse, we will first tell you what is wrong and give you a reasonable chance to put it right. If we end your licence for reasons that are not your fault, we will arrange a refund of the unused part of your licence year through Paddle.
To enforce this capability, licensing needs to be refreshed by connecting the app to the internet every 30 days. This happens seamlessly in the background if internet is available and does not share any additional information. If the app cannot connect to the internet, you will be given 5 days to connect and refresh before the app is suspended pending connection.
If we ever stop selling or supporting Visaria, we will give you at least 90 days' notice, arrange a refund of any unused part of a paid year through Paddle, and provide a final version that works without online licensing.
16. Using our website
You may use our website for lawful purposes only. Do not try to gain unauthorised access to it, interfere with it, or introduce malicious code. Website content, including text, images, videos and the Visaria name and rabbit mascot, belongs to us or our licensors. You may view it and share links to it, but please do not copy substantial parts of it without permission. Links to other websites are provided for convenience; we are not responsible for their content.
17. Third-party components
The Software includes open-source components licensed under their own terms. A list of these components and their licences is included in the app under Main menu → About. Those licences apply to those components, and nothing in these terms restricts your rights under them.
18. Changes to these terms
We may update these terms, for example to reflect changes in the law or in how Visaria is sold. The terms that apply to a purchase are the ones in force when you bought or last renewed. If we make a significant change that affects your active licence, we will tell you by email at least 30 days before it applies to you, and you can cancel before then and receive a refund of any unused part of your licence year, issued through Paddle, on proof that our changes have materially affected your ability to use your licensed solver.
19. Complaints and legal matters
Complaints
If you have a technical, account or software complaint, please email help@visaria.dev first. We aim to acknowledge complaints within 5 working days and resolve them within 30 days.
Complaints or disputes specifically about payments, billing or refunds are handled in conjunction with our Merchant of Record, Paddle.com.
Governing law and jurisdiction
These terms are governed by the laws of England and Wales.
- Consumers: You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, Northern Ireland or outside the UK, you keep any mandatory protections provided by your local laws and may also bring proceedings in your local courts.
- Businesses: The courts of England and Wales have exclusive jurisdiction over any disputes.
General provisions
- Severability: If any part of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.
- No waiver: If we do not enforce a right or provision straight away, this does not mean we waive our right to enforce it later.
- Transfer of terms: You may not transfer or assign your licence to anyone else without our prior written consent. We may transfer our rights and obligations under these terms to another business (for example, in a merger or acquisition). If we do, your statutory rights will not be reduced.
